Protecting your private information is our priority. This Privacy Policy applies to the Fire, Weather & Avalanche Center (hereinafter referred to as "FWAC") website, located at www.fireweatheravalanche.org, hereinafter referred to as "the FWAC Site" or "the Site." This policy governs data collection and usage throughout the Site. For the purposes of this Privacy Policy, unless otherwise noted, all references to FWAC include the organization and the website as aforementioned. The FWAC develops user-friendly backcountry tools for wildfire, avalanche, and weather. By using the FWAC website or by creating an account with FWAC, you consent to the data practices described in this policy. Any products, services, features, or information provided on the FWAC site will collectively hereinafter be referred to as "Services" or "the Services."

User Account Data Collection

When creating an account with FWAC, we may collect personally identifiable information (PII), including your:

  • First and Last Name
  • Email Address
  • Phone Number
  • Your City/State

This information also may be collected if you choose to create a FWAC account using Google or Facebook and allow us access to your Google or Facebook account data. When using Google or Facebook to create or login to your account, we ONLY access and collect your first name, last name, and email address. No other information is collected from those third-party platforms.

We do not collect any PII about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services available on the Site. These may include: (a) registering for an account; (b) entering a sweepstakes or fundraiser raffle sponsored by us; (c) sending us an email message. To wit, we will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.

Use of Your Personal Information

FWAC collects and uses your personal information to operate its website(s) and deliver the services you have requested.

FWAC may also use your PII to inform you of other produts or services available from FWAC.

If you choose to create an account on the FWAC website by connecting your Google or Facebook account to FWAC, you have the right to disconnect your Google or Facebook account from the FWAC website at anytime. To do this you may delete your FWAC account or go to Google or Facebook's website and disconnect from your account settings.


Sharing Information with Third Parties

FWAC does not sell, rent or lease its customer lists to third parties.

FWAC may share data with trusted partners to help perform statistical analysis, send you email, and/or provide customer support. All such third parties are prohibited from using your personal information except to provide these services to FWAC, and they are required to maintain the confidentiality of your information.

FWAC may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on FWAC or the Site; (b) protect and defend the rights or property of FWAC; and/or (c) act under exigent circumstances to protect the personal safety of users of FWAC, or the public.

Tracking User Behavior

FWAC may keep track of different behavior of our uses while on our website, including, but not limited to:

  • User click events
  • User Location
  • IP Addresses

This data is used to deliver customized content within FWAC to customers whose behavior indicates that they are interested in a particular subject area. FWAC uses Google Analytics (GA) to track this information. No personal information is ever shared between FWAC and GA.

Do Not Track

Do Not Track ("DNT") is a privacy preference that you can set in certain web browsers. We are committed to providing you with meaningful choices about the information collected on our website for third-party purposes, and that is why FWAC provides the variety of opt-out mechanisms listed above in the "User Account Data Collection" section. Automatically Collected Information

Information about your computer hardware and software may be automatically collected by FWAC. Right to Deletion

Subject to certain exceptions, on receipt of a verifiable requrest from you, we will delete your personal information from our records. Please note that we may not be able to comply with requrest to delete your personal information if it is necessary to:

  • Complete the transaction for which the personal information was collected, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and FWAC.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
  • Debug to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another users to exercise his or her right of free speech, and or exercise another right provided for by law;
  • Comply with the California Electronic Communications Privacy Act;
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievemet of such research, provided we have obtained your informed consent;
  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with usl
  • Comply with an existing legal obligation; or
  • Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

Children Under Thirteen (13)

FWAC does not knowingly collect personally identifiable information from children under the age of thirteen (13). If you are under the age of thirteen, you must ask your parent of guardian for permission to use the Site.

Email Communications

From time to time, FWAC may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from FWAC or click on a link therein.

If you would like to stop receiving marketing or promotional communications via email from FWAC, you may opt our of such communications by clicking the "unsubscribe" button or link at the bottom of the email that was sent to you. However, FWAC maintains the right to send you email message at anytime if it pertains to your account on the FWAC website. Unsubscribing from FWAC emails only pertains to marketing and announcement emails.

Changes to this Policy

FWAC reserves the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our wesbite, and/or by updating any privacy information on this page. Your continued use of the Site and/or Services available through this Site after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.
